New York Adult Survivors Act Lawyer

All victims of crimes deserve justice, including victims of sexual abuse. Unfortunately, historically, there have been barriers to victims of sexual abuse receiving justice. For a variety of reasons, sexual abuse is underreported. When reported victims are not always believed and their allegations are not always fully investigated. Because of the hard work of many advocates, and the media coverage of several high-profile cases, laws are changing and the manner in which sexual assault cases are handled has changed. If you were sexually assaulted as an adult, your deserve justice. Contact an experienced New York Adult Survivors Act lawyer at Stephen Bilkis & Associates. With over 20 years of experience successfully representing victims of abuse, we can help you pursue compensation through a personal jury lawsuit.

Sexual Assault

Sexual assault can occur anywhere. It is especially shocking when it happens in places that are generally viewed as safe places and when the assailant is in a position of trust.

With each of these places the assailant is typically someone who is in a position of power over the victim or in a position of trust. For example, there have been reports of sexual assaults by correctional officers in facilities such as Bedford Hills, Taconic, and Rose M Singer. Many correctional officers have been prosecuted and convicted on sexual assault charges. There are thousands of complaints about sexual assault by doctors, dentists, and other medical professionals each year. There are thousands of cases of massage therapists employed by major chains as well as independent locations being accused of sexual assault.

Many victims of sexual assault do not immediately report the assault because they are traumatized. When it comes to being assaulted by a boss or by a correctional officer, victims have legitimate fears of retaliation. Some victims who report the crime to management or human resources are discredited. There have been instances in which victims have lost their jobs or have been passed over for promotions. In the case of correctional officers abusing inmates, there have been instances where the abuse increased after the victim reported or the victim was sexually abused by other prison employees.

If you were the victim of institutional sexual abuse (e.g. workplace, prison, house of worship, hospital) or the abuse occurred under other circumstances, contact an experienced New York Adult Survivors Act lawyer who will advocate for you and help ensure that your legal rights are protected.

Adult Survivors Act

Just like victims of any other crime, victims of sexual assault have the right to pursue civil action against their abusers and demand compensation. However, because of the unique nature of sexual assault, there are barriers to victims coming forward and reporting the abuse. In some instances victims need the support of a therapist before they are able to speak up. Some victims speak up only after learning that their abuser has victimized others. In the case of inmates, some victims wait until after they have been released or moved to a different facility to speak up about being abused. Some victims just need time. However, because up until recently the statute of limitations of limitations that applied civil action for sexual assault was relatively brief, many victims missed the opportunity to hold their abusers accountable.

With the May 24, 2022 enactment of the Adult Survivors Act, things changed. The law provides that victims of sexual assault have the right to pursue civil action against their abusers, even though the statute of limitations has passed. To file a claim pursuant to the provisions of the Adult Survivors Act, certain conditions must exist:

  • The plaintiff must have been the victim of a sex offense as defined by New York Penal Law.
  • The plaintiff must have been at least 18 years old when the sexual abuse occurred.
  • The statute of limitations must have expired such that the plaintiff’s case would otherwise be time-barred. Recent cases are subject to the current statute of limitations

Furthermore, there is a time limitation on filing lawsuits pursuant to the Adult Survivors Act. Lawsuits must be filed between November 24, 2022, and November 23, 2023. Contact an experienced Adult Survivors Act attorney in New York right away. Failure to file your lawsuit by November 23, 2023 means that you will not be able to ever file a claim, hold your abuser accountable, or receive compensation.
