Sexual assault can occur anywhere. It is especially shocking when it happens in places that are generally viewed as safe places and when the assailant is in a position of trust.

Just like victims of any other crime, victims of sexual assault have the right to pursue civil action against their abusers and demand compensation. However, because of the unique nature of sexual assault, there are barriers to victims coming forward and reporting the abuse. In some instances victims need the support of a therapist before they are able to speak up. Some victims speak up only after learning that their abuser has victimized others. In the case of inmates, some victims wait until after they have been released or moved to a different facility to speak up about being abused. Some victims just need time. However, because up until recently the statute of limitations of limitations that applied civil action for sexual assault was relatively brief, many victims missed the opportunity to hold their abusers accountable.
With the May 24, 2022 enactment of the Adult Survivors Act, things changed. The law provides that victims of sexual assault have the right to pursue civil action against their abusers, even though the statute of limitations has passed. To file a claim pursuant to the provisions of the Adult Survivors Act, certain conditions must exist:
- The plaintiff must have been the victim of a sex offense as defined by New York Penal Law.
- The plaintiff must have been at least 18 years old when the sexual abuse occurred.
- The statute of limitations must have expired such that the plaintiff’s case would otherwise be time-barred. Recent cases are subject to the current statute of limitations
Furthermore, there is a time limitation on filing lawsuits pursuant to the Adult Survivors Act. Lawsuits must be filed between November 24, 2022, and November 23, 2023.
