Verdicts and Settlements for Car Accidents in New York
  • October 2023- $240,000 for injuries sustained in a T-bone accident. In September 2018, Taneshia Bartley, a teacher, sustained shoulder, neck, and back injuries as a passenger in a vehicle operated by Kenel Marcellus, colliding with another vehicle driven by Nia Leary in Brooklyn. Bartley sued both drivers for negligence, alleging Marcellus struck Leary's vehicle after she was obstructed by a bus. Bartley claimed injuries including a labrum tear, herniations, and radiculopathy, necessitating six months of physical therapy and shoulder arthroscopy. She missed 11 months of work and sought compensation for future medical expenses, lost earnings, and pain and suffering. Defense counsel argued Bartley's injuries were not serious under Insurance Law §5102(d), attributing them to a prior accident. Despite the $100,000 per defendant insurance policy limit, a jury found both drivers negligent, with Bartley sustaining significant limitations hindering her daily activities. Awarded $240,000, Bartley received the stipulated limit, including past lost earnings and pain and suffering, future medical expenses, and pain and suffering for 50 years. The jury determined each defendant equally liable, resulting in Bartley's recovery of the full amount.
  • December 2023- Defendant received a settlement of $2.95 million for injuries suffered in a rear-end accident. Carlos Duran Magarin, 24, was a passenger in a sedan on Bedford Park Boulevard in the Bronx when it was rear-ended by a Pelham Bay Beverage truck driven by Robert Avila on November 7, 2019. Magarin sued Avila and Pelham Bay Beverage, alleging negligence by Avila and vicarious liability for the company. Summary judgment of liability was granted in Magarin's favor, leading to a damages assessment. Magarin suffered C5-6, L4-5, and L5-S1 herniations, along with shoulder injuries including SLAP and rotator cuff tears. Treatment included physical therapy, acupuncture, pain management, and surgeries on his shoulder, neck, and back. A pretrial settlement was reached for $2.95 million.
  • February 2023. Defendant received a settlement of $1,921,625 for injuries suffered in a rear-end accident. Harold Cornwell, 69, was driving on Sunrise Highway in East Moriches when his SUV was rear-ended by Brian Breault's work van on June 8, 2020. Cornwell sued Breault and two companies believed to be related to the van's ownership and operation. Summary judgment was granted in Cornwell's favor, leading to a damages phase. Cornwell underwent multiple spinal surgeries prior to the accident and suffered head, neck, and back injuries in the crash. Cornwell's claimed injuries significantly impacted his daily life, limiting his mobility and causing him to miss important events. He continued to require medical care, including pain management and potential future surgeries. Although, the defense argued that some of Cornwell's injuries were unrelated to the accident, a pretrial settlement was reached, with Cornwell receiving $1,921,625 from the defendants' insurers, resolving the case.
  • September 2019. Plaintiff received a settlement of $3,250,000 for serious injuries suffered in a sideswipe car accident.
Notable Cases About Car Accidents
  1. Turley v. City of New York, 45 A.D.3d 547 (2nd Dept. 2007). Plaintiff Turley claimed that the defendant, the City of New York, was liable for a car accident that was caused by a police officer who was distracted while operating a patrol vehicle. The plaintiff argued that the defendant was responsible for the actions of its employee and was therefore liable for the damages caused by the accident. The court ruled in favor of the plaintiff and found the defendant liable for the damages caused by the accident.
  2. Parker v. 33 Bar and Grill Corp., 2011 N.Y. Slip Op. 30279(U) (2011). This case involved a plaintiff who was injured in a car accident caused by a pothole in a parking lot. The plaintiff claimed that the defendant, 33 Bar and Grill Corp., was liable for the damages caused by the accident. The court ruled in favor of the plaintiff and found the defendant liable for the damages caused by the accident.
